Agricultural worker visa H2A in USA for Belarusian citizens
Temporary agricultural worker visa
Agricultural worker visa — what you need to know
Issued to temporary agricultural workers performing seasonal or temporary farm work in the U.S., sponsored by a U.S. employer. Typically valid for the duration of the employment contract, up to one year, with the possibility of extension.
A job offer for temporary or seasonal agricultural work is required
The employer must confirm a shortage of suitable workers in the U.S. and obtain labor certification
The American farmer (employer) files an application for Temporary Labor Certification (TLC) with the Department of Labor (DOL)
After TLC approval, the employer files petition I-129 with USCIS
The employer is obliged to pay the Adverse Effect Wage Rate (AEWR) — the minimum hourly rate set by DOL
Process: job offer → employer labor certification → I-129 petition → USCIS approval → H-2A visa application → entry and work under the contract
The employer provides housing to workers who cannot return home daily, and free transportation between the provided housing and the place of work
Travel costs to the place of work are reimbursed after half of the contract term has been worked; the return journey is paid upon returning home after the contract ends
It is possible to relocate with a spouse and unmarried children under 21 on H-4; family status does not permit them to work
USCIS expedites the processing of H-2A petitions due to the seasonal nature of the work
Eligible individuals:
- Seasonal farmworker
